Vermont and New Hampshire are the only states that have legalized gay marriage by legislation, and the District of Columbia makes three jurisdictions. Mass, NJ, California, Iowa, and Connecticut had gay marriage imposed by judicial fiat. New York and Maryland recognize gay marriage licenses from other states.

Maine's elected government passed a law to legalize gay marriage, which was overturned by referendum. Gay marriage has been banned by statute or constitutional amendment everywhere to my knowledge where the issue has been put to the referendum.
