I can't find the facts of the case to make any judgements about Shipley. I don't know how many guns he sold and in what timeframe. Normally the ATF looks at anybody who sells more than 5 guns a year without going through at least one FFL in transfers 6 through whatever, as dealing guns without a license or being in the business of selling firearms. Also if you manufacture guns for your own use that is ok, but you cannot sell those weapons without a license period. 5 is a very low threshold for being in business and I think it actually works against ATF because you can apply this same low number to a FFL/SOT to manufacture or just sell fully auto weapons and you hardly have to do anything to be seen as being in the business and it's easy to amass a large inventory er collection which you know ATF is all against being run by a cabal of collectivists.
