Presumably the seeds produced by the non-GMO plants would incorporate the GMO genetic material. In general, farmers don't use the grain they produce as seeds for their next crop, so it's not a big deal. But this is a fairly obvious path for GMO properties to break out of their US intellectual property prison - all you need is a few seeds and a few generations of conventional plant breeding.
