Peter, or anyone who may know,

I have a question:

I am considering moving a position in one of my accounts from LGNDW to LGND. I want to do this so as to offset a rather large realized gain in 1997, with an equally large loss. :-(

My question is, Does LGND count as a "substantially" different security than LGNDW, with respect to the 30-day wash rule? I do not wish to reduce my exposure to Ligand, merely to make a tax-related switch. I know that different option series (different strikes, expiration months, etc.,) definitely count as being "substantially" different from one-another. I am pretty sure that warrants and stock also meet the criterion, but would be reassured by a concurring second opinion.

Any help will be much appreciated.

Thanks,
RB
