I think for "many folks" read Fox News and Joe the Plumber. Most small businesses are actually exempt from the more oppressive regulations. Seriously, how many people think "I'd start a business making x or selling y" if only there was less regulation? These folks don't even know what regulations there are.

Maybe you could cite a single newish regulation that a would-be small business owner might actually know about that could conceivably be a significant factor in them starting a business? The only ones I can think of are the requirements for a liquor license or for a taxi medallion, both of which have been with us for several decades.
