Overturning an enormously important and duly enacted law on a legal technicality--which is what objections to the individual mandate amount to--would be a very audacious move.
Whether the Federal Government is limited to enumerated powers, like the Constitution says, or whether the Commerce Clause gives it unlimited power is the furthest possible thing from a "legal technicality". It goes to the heart of whether we are still a Constitutional Republic or have entered into a new post-Constitutional era.
