Actually "the mandate is a tax" was one of Verrilli's backup arguments.

This is Social Security round two. FDR told the American people it was an insurance policy, not a tax. Then he argued to the Supreme Court that it was a tax.

This opens the door to all kinds of mandated monopolies. They can tell us to buy a Volt or pay a surtax.
