I hope it turns out that Roberts has just pulled a Marbury, though I wish it didn't involve leaving such an obnoxious bill as Obamacare standing. Roberts has bought himself cover for the coming Affirmative action, voting rights and campaign finance decisions. But it's a big, big bet on Romney winning and giving him some conservative judges. If Obama picks the next three vacancies on the court Robert's opinion won't matter.
