I agree with your option figures, but I think your confused about the cost basis of the remaining 40,000 shares. Through option exercise at $1.36 per share Jack King paid $136,000 for 100,000 shares, so his cost basis for each share is $1.36. The sale of 60,000 of the shares does not effect the cost of the remaining shares. He would pay taxes on the 40,000 shares he retained should they be sold at current prices.

I will repeat I'm not a fan but I think it's a stretch to conclude that this is a nefarious act, after all he could have sold all the shares.
