Right, so there was 5 against the Commerce Clause, but you said it's not a precedent against it because Roberts upheld the ACA and the others didn't. It just seems that 5 for limiting the Commerce Clause should count for something?

The explanation Mark Levin gave is the 5 could have written their reasoning down as the opinion of the court, but did not do so, probably because of Robert's late switch. However, it serves notice of their opinion, and somebody will doubtless figure out how to bring a case that can get a formal ruling.
