I don't know WTF the difference is, practically.

The revenue generated by it is part of the revenue used to offset the cost of the program. That sounds like a tax. It is designed to give the government the ability to force people to do something they don't want to do. That sounds like a penalty.

It doesn't matter. From the IRS perspective, they are identical, other than taxes are tax deductible while penalties generally are not.

Any way you look at it, it usurps our freedom.
