There is certainly room for different definitions of "necessary." Is that the disconnect you see? Orphan drugs are certainly not "necessary" to the degree that a standing army and a legal system are necessary.

But I think that meets the threshold. The people with orphan diseases certainly would consider them necessary. If the market can't responsibly respond to that need, then I don't see a problem with the government staging an intervention of some sort. Others may reasonably differ.

If the market will meet the need of it's own volition, then it's best left to the market. Governments have a role to play and private enterprise has a role to play. Functions are best assigned to the entity with the compatible role, the mindset, skill set, experience, etc. Assigning functions where they don't fit never works as well if at all. That's organizational management 101.
