I ran across this article regarding the Nomai situation. Most are certainly aware that Iomega now has a temporary restraining order againt Nomai's XHD disks, however it was interesting to me to find out they needed "evidence of distribution" to countersue Nomai. It was at COMDEX where Iomega found their "proof". Here's the link from c/net:

After reviewing the situation, I now wonder if it would be possible for Nomai to sell in the US if they somehow were to get around specifically stating that their disks were "Zip compatible".
