Even if that's so, the difference is that the discrimination is decentralized and has no universal criteria. Which means that your example does not support the notion that in the US the death panel would or could somehow manage to effect discrimination in favor of connected democrats and against successful businesspeople, as was charged.
I have no idea about death panels but I do know that withholding care beyond an average level of service is an option that is commonly chosen on behalf of a patient by health care personnel. If a person knew more and could afford it they might decide to go elsewhere for care. The medicare profession in Canada does not generally show you have a lot of options for treatment beyond their closed system.
