The imbalance that situation reveals, though...

Is that Samsung actually has something to discuss with either AAPL and/or MSFT... giving them more than one short path to address in seeking a near term solution... even discounting what Google may have up their sleeve, or what they might think about launching their own effort, parallel to that just abandoned by NOK ?

NOK still doesn't have any place at the table in that conversation... because they let MSFT con them into surrendering their seat, and were caught standing when the catchy tune playing in the OS game of musical chairs stopped...

So, Samsung could just pony up the billion... and talk to AAPL about cross licencing on similar terms as others have already... or they could go to MSFT and gain the same benefit... as MSFT are not going to turn a shoulder to them just because they have a softie insider as a ringer running NOK into the ground... ?

Given MSFT's obvious scheming in taking markets for themselves from "customers" they're back stabbing ?

Frankly, it looks to me like an opportunity for Samsung and Apple to reach an arrangement that would effectively and finally shut all the other competitors out of the market... resolving the problem of the "winner takes all" stakes in the game that has been being played... with a split pot.

I agree the poker table has been upset...

Just don't see that as a reason to expect that a vast majority of the chips are going to land standing on edge, rather than heads or tails up...
