The second lien folks will not own debt when this is over. How the equity of the company is spread around depends on the valuation that the judge affords to the company when it exits. Hopefully, it will come to pass that everyone gets something. The fact that Judge Isgur is a bit nervous about the small size of the DIP facility after the rollup of the first lien debt into it is of concern to me. Also of concern to me is the bonding requirements of the Bureau of Land Management made on 8/17 prior to the bankruptcy which appear to have been only disclosed in filing 248 of today.
