Early in the game to gauge. When I go into these, I assume that I will not get par. Sometimes I get surprised. CPN and MIR come to mind. A lot depends on the judge. As I said, I am rooting for a full recovery by everyone. Enlightened self interest and all. Also perhaps what is "fair" though that is a slippery word. The DIP seems greedy, the judge seems reasonable, ATPG seems incompetent (the normal management style) and who gets what is still up in the air. The fact that the Trustee here is considering an official shareholders' committee is certainly better than having her tell them take a hike.
