BTW - the controversy illustrates the problem with laws/regulations. The complexity mushrooms as everyone tries applying the reg to various fact patterns or agencies issue rulings or judges decide cases. The complexity gets so difficult the outcomes are no longer predictable even by skilled lawyers. That is a big problem.
