I once thought any shares shorted without permission from the long's broker was considered illegal. But it seems to be so rampant, that I wonder if the legal/illegal breakpoint is when the shorted shares exceed the float at the time they were shorted.

As I said, legal or illegal, they still have to cover the short when the certs get called.
