As I understand it...

For a stock to be shorted by investors, it has to be a marginable stock. Most bulletin board stocks are not marginable. However, MMs are legally allowed to short non-marginable stocks. That's part of their day-to-day business. Also, off-shore accounts are able to legally short non-marginable stocks. However, I understood any and all naked shorting -- from investors, off-shore or otherwise, and from MMs -- is not legal. That's my understanding. Any input to the contrary is welcome.
