Yes, I believe that is the case. There is no way that the fed gov can go beyond this, considering constitutional constraints.
There are two arguable positions here. 1) Many believe the fed is already infringing on on constitutional protections. 2) Constitutional constraints are interpreted by the Supremes and they may be persuaded to interpret those constraints differently going forward. Time will tell, but this whole area is a concern that has private citizens up in arms (pun).
