Yep.

A three judge panel ruled against him (all three appointees of GOP Presidents... though I'm SURE that had absolutely no bearing on their thinking here...), while another Appeals panel elsewhere in the country ruled exactly the opposite way.

Looks like this one is headed (in a couple of years) straight to the 'Supremes' for a resolution.

(Care to venture a guess as to how their decision will go?)
