03/19/2013 ORDER as to Michael Metter: Based on the court's review of the presentence report prepared in this case, the government's reasons for extending a plea offer under Fed. R. Crim. P. 11(c)(1)(C), and defendant's guilty plea allocution before me on January 14, 2013, the court accepts defendants plea of guilty to the one count of the superseding information (S-2). The Court finds (1) the defendant understood his constitutional rights and the consequences of pleading guilty; (2) the defendant knowingly and voluntarily waived his constitutional rights by pleading guilty; and (3) there is a factual basis for the plea. Accordingly, the Court hereby accepts the defendant's plea of guilty to the one count of the superseding information. A separate order will be entered setting forth a schedule for sentencing.
