Assuming that ATPG is able to reorganize in some form, the new company will have the case against BP as an asset. It won't be decided before ATPG reorganizes. I think (speaking as a non-lawyer) that it;s probable they would receive something from BP - either as a settlement or verdict. BP has certainly paid out money for much weaker cases than what ATPG has against them.

I don't buy the argument that the case is too expensive to litigate. They have lawyers on staff anyway. I don't buy the argument that it has to be funded in a big way currently. They probably just do a couple of filings to get the case in court and pay the bulk of the costs at the trial which would happen after they hopefully reorganize.
