Why is upper level quiet at DOJ? CYA time? You have to understand the trouble they are going to have here. CBS is reporting a foreign government asked us to look into the older brother for extremist activities two years ago. The FBI did and found nothing. Then they closed the case. Two years later the same guy goes to Russia for six months and has a digital trail of hostility towards our country. This is the classic situation where the feds have so many tools and just can’t get it right.

—As first reported by CBS News correspondent Bob Orr, the FBI interviewed Tsarnaev, the elder brother of at-large bombing suspect Dzhokhar A. Tsarnaev, at the request of a foreign government to see if he had any extremist ties, but failed to find any linkage.
Both Tsarnaev brothers were legal permanent residents of the U.S. There is no evidence so far that either brother received any tactical training.
CBS News correspondent John Miller reports it is likely Russia asked to have the elder Tsarnaev vetted because of suspected ties to Chechen extremists.
The FBI is likely to have run a background check, running his name through all the relevant databases, including those of other agencies, checking on his communications and all of his overseas travel. Miller reports that culminated in a sit-down interview where they probably asked him a lot of questions about his life, his contacts, his surroundings. All of this was then written in a report and sent it to the requesting government.
This is an issue they’ve had in the past. They interviewed Carlos Bledsoe in Little Rock, Ark., before he shot up an Army recruiting station in 2009. They were also looking into Major Hasan Nadal before the Fort Hood shootings.
However, the FBI has maintained in those incidents that they took all the steps they were asked to and were allowed to under the law.
Although the FBI initially denied contacting Tsarnaev, the brothers’ mother said they had in an interview with Russia Today.
Zubeidat Tsarnaeva said her son got involved in “religious politics” about five years ago, and never told her he was involved in “jihad.”

Trust me, as my buddy pointed out before, the hesitation over releasing a GOOD photo of the suspects was not by accident. They knew. They also knew they had dealt with him before. It was a “Uh, boss, before you go out there and say something on video we can’t take back, can I offer up a suggestion? We might need to wait a little and get our act together about what we knew and what we didn’t do in case someday we are testifying in front of Congress. And I figure that’s a guarantee! ”
Some of the actions the feds took didn’t make sense to us who have some experience with those of us who handled investigations.
First, they had good photos but didn’t put them out right away. It could be because they were trying to find them through cellphones or intel. And maybe they didn’t want to turn it into what it turned into- a deadly rabbit chase. However, as we have now found out the two had more bombs and weren’t done planning attacks. So the question becomes do the feds let them bomb more while swimming around in circles, or put out their faces and hope for the best?
However, what if they already knew about the older brother. They had a file. They had a heads up from a foreign government. That’s not something to be dismissed lightly. It isn’t like an agent just decided to open a file on a hunch and found out it was bad lead. This was a case where a foreign agency- probably intelligence- contacted THEIR leaders who contacted OUR leaders…about the threat they felt was real from ONE person.
And they closed the file. After they did the subject became more and more radicalized and openly so. You would think even if the file was “closed” there would be some monitoring of a subject another country felt dangerous.
But as we are seeing now, the first subject had no problem spouting the exact kind of bilge a number of other radicalized extremist spouted before they went and did something. And the feds didn’t see it coming.
Second, I’m sure the Congress will want that file, and the agent who wrote it, the supervisor who signed off and everybody up and down the line. It will go something like this, “This is Theodore Davenport, the aide to Senator Ass Chewer from Texas. We ‘all were wondering if you could sent that WHOLE file over to us for a peek? Of course, we’ll be sending a subpeona, but we thought we’d ask first. Whatcha’ say to that there partner?”
This is the nightmare all of the federal bureaucrat fear the most.
The “Uh, Mr. Senator, uh, we…uh…is it me or is it hot in here? What can I say we screwed the pooch?”
Third, my buddy found it odd certain foreign governments were quick to deny knowledge, yet Russia asked for a formal request. Again…stalling.
He reminded me of the time difference. There was no way those governments could know if they had or didn’t have any information on two guys they didn’t know the names of until all the agencies were closed. That suggests names and information were already out there- quietly.
What will happen is now that the kid is alive is the story won’t die. He’ll be held, transferred, talked to, and get counsel. At some point we may find just how deep this cell ran.
And we’ll find just how well some feds can dance. Remember it isn’t the line agent screwing up. (He may have just been the one to “leak” the information. Or some local cop attached to the JTTF. Somebody wanted to make sure it got out.). This is about a system that was supposed to be fixed over the last ten years still wobbling around inside a bureaucratic, politically correct disaster.
And this is a case where the MSM and the new media have been given one hell of a gift. One I’m sure Diane Sawyer will ignore with vigor, as will Matthews and Maddow. But the rest; Bill, Bret Baier at FOX, Major Garret at CBS, even us will push this until we know the truth.
I can only hope the MSM or the new Media will keep the fire here going strong.
Unlike Fast and Furious where two of the key witnesses were spirited out of the country by the government right under the noses of the media. I can only imagine if one day in the future MacMahon opens his office door at his office in the Philippines and discovers another desk next to his and a former FBI supervisor glaring at him and saying “Don’t ask.”
If that happens we failed.

So that’s why I think that it’s a set-up.”
