Nothing about the legalization of marijuana says, or should say, that employers have to hire or keep someone who is abusing drugs.

This decision won't be followed in some states as legalization proceeds, however. You think a CA court would hold with this finding?

While I'm pro-legalization, I can't see how any employer should be required to keep on a person who is failing drug tests. Or who the employer knows is getting shit faced drunk on a daily basis. We know that frequent marijuana use can reduce the drive and creativity of a person. I wouldn't want such a person working for me.
