Charging smokers more for health insurance: Here's what you need to know

There is a growing trend of employers offering discounted health insurance premiums to nonsmokers (this seems preferable to calling them penalties or surcharges for smokers). Nonsmoker discounts are easy to design and implement, and can be done without involving your health insurance company.

However, the Health Insurance Portability and Accountability Act (HIPAA) does consider smoking to be health related (that being the medical addiction to nicotine), so nonsmoker discounts should meet a few basic requirements in order to be compliant with HIPAA as a bona fide wellness plan.
