I don't think it is nonsense for a state to reaffirm, a priori, that it will refuse to follow law that IT determines to be unconstitutional.

One could certainly argue that, for example, had the US Congress understood that not all states would just blindly carry out unconstitutional portions of the ACA, the train wreck which is now expected by both Baucus and Reid, might have been avoided. That's not to suggest the arrogance of Democrats in Congress, who believed it incumbent on them to enact legislation that Americans did not (and do not) want, might have taken another route -- they probably wouldn't. But at least everyone would have known the score going in and different actions might have been taken during implementation.

Had Congress been aware that several states would choose not to participate, it would at least have been possible to avoid some of the harm that will be caused by ACA to have been mitigated.
