BILL ALLOWING FOREIGNERS TO ACQUIRE HOMES AT THE BEACHES AND BORDERS

La Cámara de Diputados aprobó recientemente una iniciativa de reformas a la Constitución Federal que, de ser aprobada por la Cámara de Senadores, permitirá a los extranjeros adquirir el dominio directo de inmuebles ubicados en las playas y fronteras de México. Para lograr lo anterior, los extranjeros deberán adquirir dichos inmuebles únicamente para fines de vivienda y convenir con la Secretaría de Relaciones Exteriores en considerarse como mexicanos respecto de dichos inmuebles y no invocar la protección de sus gobiernos por lo que se refiere a los mismos. Es de hacer notar que tales inmuebles no se podrán destinar a fines comerciales. La sanción en caso de que el inmueble se destine a fines distintos a los de vivienda sería perder la propiedad de los mismos a favor de la nación mexicana. Si el Senado aprueba la reforma constitucional, los extranjeros ya no tendrán la necesidad de recurrir a fideicomisos. Asimismo, los extranjeros que actualmente tienen propiedades en las playas y fronteras a través de fideicomisos, podrán darlos por terminados y adquirir la propiedad directa de las mismas, evitando así el pago de los honorarios fiduciarios que esto implica.

The House of Representatives recently approved a bill amending the Federal Constitution, which if passed by the Senate, will allow foreigners to have direct title to real estate located at the beaches and borders of Mexico. For such purposes, foreigners must acquire said real estate for residential purposes only and agree with the Ministry of Foreign Affairs to consider themselves as Mexicans in connection with said real estate and not to invoke the protection of their governments with regard thereto. Note that such property cannot be used for commercial purposes; the penalty for using it for purposes other than residential is to forfeit real property in favor of the Mexican nation. If the Senate passes the bill, foreigners would no longer have to acquire title to said real estate through trusts; and those that currently own property at the beaches and borders through trusts would be able to terminate the trust agreements to have direct title thereto, not having to pay the corresponding trustee fees that this involves.
