Germs cause disease under the right circumstances is a more specific statement, but it it true (and it is), then the more general "germs cause disease" is also correct.

Its not clear to me if your trying to claim that "germs cause disease" is false, or if your saying that Maher didn't make such a statement. If the former, then your wrong. If the later then I can't really address the issue.
