You are absolutely right. JMAR's placement was at a FIXED price and not subject to a conversion at an average price. For those thinking the Swiss would be shorting the stock to get it to go down is ridiculous. The only way for them to make money is for the stock to go up in value. Can you imagine the SWISS to invest several million dollars in a company and then say, "let short this baby and see our net worth decline". I would like to think that they are smart enough to invest millions in a company to see the stock go up and not down.
