This is interesting. Remains to be seen if this guy who leaked the NSA snooping news did anything illegal. I am not sure if his job contract involved secrecy in which he could not reval anything that he learnt because of his job responsibilities. Even if that is the case, I am sure the ACLU lawyers will stand behind him and argue that his job clause was illegal. After all, the Govt. needs to explain why it thought it needed to keep it secret. If I was the President, I would want the enemy to know that they are under surveillance and "to not use the Internet and phone calls to communicate with their cell members." Being able to strike with drones, put these terrorists on surveillance etc. would serve as a deterrence, which should be the goal. If the Govt's aim is to make it punitive, then it becomes a hide and seek with the terrorists where they have to be right just once. But if it it is deterrence, then they may seek other ways such as couriers. And if they do, we can then go after them.

What is also noteworthy is that in this case all the three branches of Govt. acted together and hence have to bear joint responsibility including the political parties.
