It is really kind of a useless argument -- the question is whether it is acceptable. IMO, it isn't.

We are in totally different circumstances from what they were in the few years after 9/11. GWB successfully eradicated the threat from AQ, but it took some time and during that time our intelligence community was having to use every measure to get a handle on the threat. Once GWB had destroyed AQ, the need for this kind of information is diminished.

A second, important point is that GWB could be trusted with the data while Obama cannot be. Obama would not think twice about using these data to his political advantage, just as he did the IRS data. And we could well have future presidents who will go beyond that even. There is really little reason why NSA can't just hang onto everything they grab off the Internet at this point, and promise to access it only with court approval. And not use it for political purposes. Until they do.

The simple truth is the Obama administration has no scruples and cannot be trusted. You cannot count on every president to have the absolute integrity of a GWB. Future presidents might be as bad or worse than Obama. Even phone call metadata is extremely invasive if in the wrong hands.

My belief is that individuals' private information should be available to government on a "need to know" basis. If they have a legitimate need, then fine -- show the need and it can be duly considered whether that need is essential or not. But I really don't think aggregating a pile of data "just because we can" makes any sense at all.
