My god. Do you think Obama isn't doing precisely the same?

There are already lawsuits flying over this crap. To suggest that federal judges are somehow final arbiters of what is and is not "legal" is sorta naive, particularly considering the disparity amongst various circuits.

The Ninth Circuit isn't going to be agreeing with Bush on anything, and will probably be fine with anything Obama does.
