Well, right now, we already have a constitution and there are approved means of amending it if the public will to do so is strong enough.

How do we know we have the right level? If the government isn't intruding on the rights of the people then we have the right level.

Right now, we have a government that presumes to tell us what kind of light bulbs we ought to use, just to pick an example. The government shouldn't do that. Shouldn't tell us what kind of cars we ought to buy or what kind of health insurance we ought to buy and etc etc etc.
