It's possible they could tweak the silver so that the delivery mechanism is patentable. So I disagree with you that this is unpatentable. And the research labs are often a first step in finding new ways to patent old technologies. That's the first obvious answer. Second, I think the government should be in the business of developing needed orphan drugs. It only makes sense, since there is no incentive for the private sector to do it, if they can't make a shitload of money. My husband has worked in pharma for years- so I'm pretty sanguine on them finding a way to cleverly manage to patent the use of silver, but if they can't, I'd like the government to step in.
