Hard to bring a criminal case without an indictment. Precisely. If you don't have the evidence to produce an indictment, you can't bring a criminal case. Bar is much lower for civil cases. If any AG could have indicted, they would have. More had jurisdiction than just the Feds. That said, Holder hasn't been the brightest star in the night sky.
