I'm sorry. I forgot to take into account that your reading comprehension was stunted. Martin's injuries were limited to the gunshot wound. He didn't have wounds to his face or back of his head. Therefore he wasn't being beaten. He wasn't the person on the bottom. He wasn't screaming for help. He was the attacker. He was the man on top. He was the person who was the aggressor. And he attacked a man who had a gun. So the fact that he ended up dead doesn't make him the victim. It makes him a thug who attacked the wrong guy.
