Based on my experience in this profession, Ashby's statement that he is "comfortable" with Q4 and FY98 results would only be made if bookings (ie. contracts) support this. Otherwise, because of the pending lawsuit, he would have been advised by legal counsel to state that results are on track. I wouldn't be surprised of an upside surprise in Q4 earnings of between .26-.28 per share
