Frank,

Prior to the issuance of the patents, the company said they were in talks with a number of prospective partners and that deals would be forthcoming very shortly after the patents were issued. They specifically indicated that they were only waiting on issuance of the patents to make these deals, so their intellectual property would be adequately protected. Your scenario assumes that negotiations did not begin until after issuance of the patents; I do not think that is correct.
