longnshort, I am surprised that you, as a conservative want to violate an individuals Constitutional rights of free speech on an individual guaranteed in Amendment I: Congress shall make no law respecting and establishment of religion, or prohibiting free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Legally, no person can be fired or punished for exercising their constitutional rights without repercussions. If such a Board of Education did take such action against the teacher and administer, and there was not any such policy against such activity, that organization could be sued. Regarding this matter I do not know what the case law has determined. However, I do not believe that you would want your school district in State or Federal Court being sued, and be liable for possible damages. Additionally, could the individuals who slandered the teachers supporting the terminated teacher be sued?
I do not know what the circumstances were around the case. I do know that the school district, if the charges were correct, has the right to terminate the teacher after due process and just cause in a court of law. The charged teacher if guilty should, in my opinion, be fired and kicked out of the profession and whatever the courts deemed necessary as punishment ASAP. |
