TKA, I was under impression that SEC Form 4 is for insiders as INDIVIDUAL investors, not for the company as a whole.
If the Company buys or sells, it should not be treated as Form-4 trade (I beleive), because it does not go to anybody's individual account. The question whether or not they should tell BEFORE they buy shares on the open market as a Company remains open. They will sertainly need to tell AFTER, since they will have to report (in 10k, for example) what happened with the 2mil "or a part thereof."
