Houston carjacking victim may not face charges for shooting attackers .... Police said the owner of a gold-colored Pontiac sedan with decorative rims had pulled up to DVD movie-rental kiosk outside the McDonald's. He was apparently returning a movie at the kiosk when the suspects, who carried guns, confronted him. They demanded his car keys and cell phone and got into his car to drive away. A third suspect then sped away in a 1999 dark-green Honda Civic. When the suspects began to leave in the man's car, the owner pulled out a gun and opened fire. The bullets smashed through the driver's side window and the windshield, wounding both suspects. Police said the car's owner has a license to carry a concealed handgun. Police said one of the suspects, identified as 25-year-old Melvin Frederick Austin, died at the scene. The other suspect, identified as 32-year-old Elijah Alexander Mims, ran away after the gunfire. He was picked up by the third suspect who was driving the green Honda. Mims was later dropped off at a hospital in College Station. Hospital staff alerted police about Mims and he was taken into custody. Police said Mims is charged with aggravated robbery with a deadly weapon.
