Now if the Democrats had been serious about anything but a symbolic vote, they would have filibustered. And they had the votes to block cloture. But they didn't filibuster.
True, but there was no conservative analog to ObamaCare that was rammed through Congress without Democrat support. Even the Patriot Act, along with the Iraq and Afghanistan wars, were approved by enough Democrats to make it not worth filibustering over.
