The "point-to-multipoint" transmission model, apparently soon to be approved (if not already approved) seems to eliminate this concern:

From the 11/13 tape:

"...Another potential limitation on the technology is that it requires a line of sight between the two dishes that form a link. But, Van Dussen said an emerging strategy called "point-to-multipoint" - under which a single hub broadcasts transmissions to several other places without the line-of-sight requirement - might render such limitations moot...."
