Could A Climate Scientist’s Defamation Suit Shut Down The Nation’s Leading Conservative Magazine?


There is a big difference in the criteria to be met for a suit dismissal (that under the legal theory alleged not one fact in the complaint would support it--or something like that) and winning the suit ( a combination of facts must show the plaintiff prevails by a preponderance of the evidence). In other words it's not that much of a legal deal at this point in time that the plaintiff beat the defense motion to dismiss.

Although, this does mean the National Review and Company are going to have come up with the legal fees to defend it--and if that makes every one a little more logical and rational on their blogs that is a good thing IMHO. Also, IMHO, based on the facts cited by the judge I think there will be enough of factual basis (if the emails to the East Anglican climate scientists are as alleged by the National Review blogger/writer--that is that in fact the climate scientist did urge manipulation of the data to the East Anglican climate scientists) then I think the defendants will ultimately prevail here (truth being a defense to defamation)
