Simple.

Imagine a road rage driver barreling down the street. You're in a cross walk with a dear friend and realize the speeding driver won't stop and the only way to save your friend is by pushing he rout of the way and being killed yourself.

Is the driver not at fault because you gave up your life for your friend?
