CLAIMANT UNITED STATES OF AMERICA’S MOTION FOR DISBURSEMENT OF FUNDS

Pursuant to Magistrate Judge Azrack’s orders of January 10, 2014, (Docket # 312), and February 4, 2014 (Docket # 318), which extended claimant United States of America’s time to file until February 27, 2014, claimant United States of America (on behalf of its agency the Internal Revenue Service) files its motion for disbursement of funds.[1]

The United States requests that this Court issue an order directing the disbursement of $123,856.97 from the Court Registry Investment System Account (“CRIS Account”) to the governemnt. This amount represents the IRS’s unsecured priority claim for defendant BusinessTalkRadio.net.Inc.’s (“BTR’s”)/Greenwich Broadcast Corp.’s employment tax liabilities for the tax periods ending June 20, 2011, December 31, 2011, March 31, 2012, and June 30, 2012, which consists of $93,160.25 of tax due and $2,195.88 of interest through the petition date of the receivership of these entities as well as $28,500.84 of penalties, including interest thereon, to the date of the petition for receivership. Our memorandum of law in support of this motion is attached herewith.

[1] As the Court’s orders directed the United States to file a motion, we have interpreted the Court’s order to mean that the government should electronically file its motion on the ECF system by the due date.
