It varies by state, and the extent of enforcement may vary substantially even for localities within a state. In some states, the quantity has little or nothing to do with it.

While it is true many states have begun to recognize their penalties are insanely harsh there are still a number of people in this country serving life sentences for nonviolent marijuana possession.

In the state of Louisiana, one of the egregious states run by absolute monkeys, if you are in possession of more than 1 oz of marijuana you can be charged with distribution. If you are charged, you have no choice but to plead guilty, because if you are convicted, you can receive a 30 year sentence. This sounds absurd but it is a fact. There does not have to be one bit of evidence suggesting you are guilty of distribution, the cops just say, "You're being charged with distribution." It is unconscionable. A couple years ago a man was sentenced to life for a fourth conviction of distribution down there. Nonviolent. Harmless. Life in the pen.

You can try to defend it all you want, but it is indefensible.
