Socrates said this before he we was sentenced to death.
He may indeed perhaps condemn me to death, or exile, or disgrace; and he or some other may consider these as mighty evils. I however do not think so; but, in my opinion, it is much more an evil to act as he now acts, who endeavours to put a man to death unjustly.

Brumar has an interesting twist on this and claims Socrates wasn't really sentenced to death but committed suicide...
